The Centre has given green signal to the notification seeking constitution of one-member Benches in National Green Tribunal (NGT) in exceptional circumstances. The notification has been allowed by the Centre in pursuance of recent amendment to the National Green Tribunal (Practices and Procedure) Rules, 2011.
Rule 5 of the NGT Rules provides for the minimum number of members who shall hear the application. According to the Rule the Tribunal shall hear the application or appeal, as the case may be, consisting of atleast by a Judicial Member and an Expert Member. The amendment brought about by the Ministry of Environment and Forests on December 1 incorporates a proviso to the Rules that provided that in exceptional circumstances the chairperson may constitute a single-member bench.
